Large Oak Tree

Large Oak tree at rear of residents property in small alley way. Years ago resident in Courtleet Drive has claimed the area and put up fence around this Oak tree. He is not interested in doing anything about the over hanging branches takes up third of garden. Needs to be cut back but they are elderly and cannot do this. They would like to know if a TPO on this tree ? Can it be cut back ? who is responsible because for years the council use to maintain this tree but now has been left. She has contacted tree people to have cut down but now needs information please ?
